1. Acceptance & Virginia Governing Law
By accessing or using the Timorian Restaurant services, you agree to be bound by these Terms and Conditions. These terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles. Any dispute arising from these terms shall be resolved exclusively in the state or federal courts located in Alexandria or Fairfax County, Virginia.
2. Online Ordering & Payments
Order Accuracy: Under Virginia consumer protection guidelines, we strive for 100% accuracy. However, customers are responsible for reviewing their cart before submission. Once "Placed," orders are final.
Refunds: Perishable food items are generally non-refundable. Refunds or store credits are at the sole discretion of management and are typically only granted for significant quality issues or incorrect items reported within 2 hours of pickup/delivery.
Payment Security: Payments are processed via Shift4 Payments. Timorian Restaurant maintains compliance with the Payment Card Industry Data Security Standard (PCI DSS).
3. Allergy & Virginia Food Safety Notice
MANDATORY NOTICE:
Timorian Restaurant operates in compliance with the Virginia Department of Health (VDH) regulations. Our kitchen prepares dishes containing nuts, wheat, eggs, dairy, and soy. While we take precautions, cross-contact is possible.
Consuming raw or undercooked meats, poultry, seafood, shellfish, or eggs may increase your risk of foodborne illness, especially if you have certain medical conditions.
4. Reservation & Cancellation Policy
Reservations are subject to availability. We reserve the right to cancel or modify reservations due to private events, unforeseen closures, or "no-show" history. Special events or large parties (6+) may be subject to a cancellation fee if not cancelled within 24 hours.
5. Limitation of Liability & VCDPA Transparency
To the maximum extent permitted by Virginia law, Timorian Restaurant shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our website or services. Our maximum liability for any claim shall not exceed the total amount paid by the customer for the specific order in question.
